End User License Agreement

1. Definitions

• “Software” refers to all 360APPS products including web applications, downloadable desktop applications, browser extensions, add-ons, plugins, and related documentation.
• “Licensor” refers to 360APPS and its affiliates.
• “You” / “User” refers to the individual or entity using the Software.
• “Web Apps” refers to browser-based applications accessed through 360apps.net.
• “Desktop Software” refers to downloadable applications for Windows, macOS, or Linux.
• “Add-ons” refers to plugins or extensions for third-party software (e.g., Blender add-ons).
• “API Key” refers to authentication credentials for third-party services that you provide.

2. License Grant

2.1 Grant of License

Subject to the terms of this EULA, 360APPS grants you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use Web Apps through your browser while your subscription is active
• Download and install Desktop Software on devices you own or control
• Install Add-ons in compatible third-party software

3. Software Types & Specific Terms

3.1 Web Applications

Web Apps are accessed through your browser at 360apps.net. These include:

• Touchpoint – Contact management application
• AI Photo Maker – AI-powered image generation
• Teleprompter Online – Script reading tool
• All productivity, audio, video, and utility apps

3.2 Desktop Applications

Downloadable software includes:

• HDRI Creator – Windows application for creating HDR images
• Other desktop tools as released

3.3 Blender Add-ons

Add-ons for Blender 3D software are licensed perpetually upon purchase and may be installed on unlimited personal devices.

4. Third-Party API Keys

4.1 API Key Responsibility

When you provide your own API keys (e.g., OpenAI, Stability AI, Google, etc.):

• You are solely responsible for obtaining and maintaining valid API keys
• You must comply with the third-party provider’s terms of service
• You are responsible for all costs and usage charges from the API provider
• You must not use API keys obtained fraudulently or in violation of any laws

4.2 API Key Storage

• API keys entered in web apps may be stored locally in your browser
• We do not store or transmit your API keys to our servers unless explicitly stated
• You are responsible for keeping your API keys secure

4.3 Third-Party Service Limitations

360APPS is not responsible for:

• Service interruptions or changes by third-party API providers
• Rate limits, quotas, or restrictions imposed by API providers
• Charges incurred through your use of third-party APIs

5. AI-Powered Services

5.1 AI Applications

360APPS offers AI-powered applications including:

• AI Photo Maker – Image generation and editing
• YouTube SEO AI Generator – Content optimization
• Other AI-enhanced tools

5.2 AI Content Ownership

• You retain rights to content you create using AI tools, subject to the AI provider’s terms
• AI-generated content may be subject to additional restrictions from underlying AI providers
• Commercial use of AI-generated content may require separate licensing

5.3 AI Usage Restrictions

You agree NOT to use AI features to generate:

• Illegal content
• Deepfakes or non-consensual intimate imagery
• Content that infringes intellectual property rights
• Hateful, violent, or discriminatory content
• Spam or misleading content
• Content depicting minors in harmful situations

6. Restrictions

You may NOT:

• Copy, modify, or distribute the Software except as permitted
• Reverse engineer, decompile, or disassemble the Software
• Remove or alter any proprietary notices or labels
• Rent, lease, lend, or sublicense the Software
• Use the Software for any illegal purpose
• Share your account or license keys with others
• Resell access to the Software or its outputs

7. Intellectual Property

360APPS and its licensors retain all rights, title, and interest in the Software. This EULA does not grant you any ownership rights.

8. Updates & Support

• Web Apps are automatically updated
• Desktop Software updates may be provided at our discretion
• Support is provided via email for active subscribers

9. Data & Privacy

Your use of the Software is also governed by our Privacy Policy. Many 360APPS products process data locally on your device without uploading to our servers.

10. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• 360APPS shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid in the 12 months preceding the claim
• We are not liable for damages resulting from your use of third-party API keys

12. Termination

We may terminate this license immediately if you breach any term of this EULA. Upon termination, all license rights immediately cease and you must uninstall all copies of Desktop Software.

13. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

For users in the European Union, nothing in this EULA affects your rights under applicable consumer protection laws in your country of residence.

Any disputes arising from this EULA shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
